Terms of Service

Please read these terms carefully before using our short-term rental management services.

Agreement Overview

These Terms of Service ("Terms") govern your use of ATX Stays Management services and constitute a legally binding agreement between you ("Client" or "Property Owner") and ATX Stays Management LLC ("Company," "we," "us," or "our"). By engaging our services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

1. Service Description

ATX Stays Management provides comprehensive short-term rental management services for properties in Austin, Texas, including but not limited to:

  • Listing creation and optimization on platforms including Airbnb, Vrbo, and Booking.com
  • Dynamic pricing management and revenue optimization
  • Guest communication and customer service (24/7 for Pro and Premium plans)
  • Cleaning and maintenance coordination
  • Professional photography services
  • Financial reporting and accounting
  • Regulatory compliance assistance

Service levels vary by plan selection (Starter, Pro, Premium) as detailed in our current pricing structure available at atxstays.com/pricing.

2. Management Agreement

By engaging our services, you grant ATX Stays Management the authority to:

  • List and market your property on short-term rental platforms
  • Set pricing and availability based on market conditions and your preferences
  • Communicate with guests on your behalf
  • Coordinate cleaning, maintenance, and repairs up to pre-approved limits
  • Collect payments from guests and distribute revenue according to our fee structure
  • Make decisions necessary for day-to-day property management

You retain ownership of your property and may terminate this agreement with 30 days written notice.

3. Fees and Payment

Management fees are calculated as a percentage of gross booking revenue:

  • Starter Plan: 15% of gross booking revenue
  • Pro Plan: 20% of gross booking revenue
  • Premium Plan: 25% of gross booking revenue

Additional services such as cleaning, maintenance, and supplies are billed at cost with no markup. All fees are deducted from gross revenue before distribution to the property owner. Detailed monthly statements will be provided showing all income and expenses.

Revenue distributions typically occur within 3-5 business days after guest checkout, subject to platform payment processing times.

4. Property Owner Responsibilities

As a property owner, you are responsible for:

  • Maintaining all required Austin STR licenses and permits
  • Ensuring property compliance with local regulations and safety requirements
  • Providing adequate property insurance including liability coverage
  • Furnishing the property appropriately for short-term rental use
  • Providing accurate property information and documentation
  • Promptly addressing any property-specific issues that arise
  • Maintaining the property in good condition and repair

Failure to maintain proper licensing, insurance, or property condition may result in service suspension or termination at our discretion.

5. Liability and Insurance

ATX Stays Management maintains professional liability insurance for our management services. However, property owners are required to maintain:

  • Comprehensive property insurance covering short-term rental use
  • Liability insurance with minimum $1M coverage
  • Additional coverage as required by local regulations

We are not liable for property damage, theft, or guest-related incidents beyond our professional management services. Property owners assume responsibility for their property and guest safety.

Our liability for management services is limited to the management fees paid in the preceding 12 months.

6. Termination

Either party may terminate this agreement with 30 days written notice. Upon termination:

  • We will transfer all listings and accounts back to the property owner
  • Final payment settlement will occur within 30 days
  • We will provide all necessary documentation for transition
  • Existing bookings will be honored through completion

We reserve the right to terminate immediately for breach of contract, illegal activity, or failure to maintain required licenses and insurance.

7. Intellectual Property

Professional photographs, marketing materials, and listing content created by ATX Stays Management remain our intellectual property but may be used by the property owner for their property marketing purposes. You grant us permission to use property images and information for our marketing and promotional materials.

8. Privacy and Data

We collect and process personal and property data as necessary to provide our services. Our data handling practices are detailed in our Privacy Policy. Guest data is handled in accordance with platform requirements and applicable privacy laws.

9. Dispute Resolution

Any disputes arising from this agreement will be resolved through binding arbitration in Travis County, Texas, under Texas law. Both parties agree to attempt good-faith negotiation before pursuing formal dispute resolution.

10. Modifications

These Terms may be updated from time to time. Material changes will be communicated with 30 days notice. Continued use of our services after changes constitutes acceptance of modified Terms.
